FCC gives last chance to CDA to frame rules for Katchi Abadis, adjourns hearing for 4 weeks

ISLAMABAD
Federal Constitutional Court (FCC) while giving last chance to CDA to frame Katchi Abadis regulations has adjourned the hearing of the case for 4 weeks.
Chief Justice FCC, Amin ud Din Khan and Justice Arshid Hussain heard the petition filed against demolition of kachchi abadis.
CJ FCC Amin ud Din Khan said why the regulations of Katchi Abadis have not been framed so far.
Additional Attorney General (AAG) told the court chairman CDA has been transferred. Due to it the matter was delayed. Draft bill is prepared and approval will be given in next meeting of the board.
Faisal Siddiqui counsel for the petitioner said no one can be ejected over night. This is Islamabad and not Ghaza. This case be considered mercy appeal.
CJ FCC Amin ud Din Khan said is any area reserved for Katchi abadis in Islamabad.
AAG said there is no existence of Katchi Abadis in CDA master plan.
The Katchi abadis set up till 1995 were recognized on humanitarian basis.
Faisal Siddiqui said we are being made homeless despite 2001 and 2016 policies.
CJ FCC Amin ud Din Khan said if policy is there then what is problem.
Faisal Siddiqui said the problem is implementation of policy which can become possible due to your order. No one can be ejected without giving alternative place.
Counsel for CDA Qasim Choohan said the place given in the name of Katchi Abadi in Islamabad is being misused. Separate homes cannot be provided each to 10 children of one person in Katchi Abadi. The people did not vacate old places despite alternative places. We are facing problem to get vacate Kachi abadis this way.
Counsel Faisal Siddiqui said there are more than 4 lac people are living in Katchi abadis. It was admitted in master plan that 50 percent Islamabad is living in Katchi abadis. Katchi abadis are being demolished over night.
AAG said most of the Katchi abadis are under the control of mafias. Mafias get construct katchi abadis and then occupy them. The mafias sell out the possession of land following establishment of Katchi abadis.
The court while giving time to CDA for formation of rules adjourned the hearing of the case for 4 weeks.
