Justice Naeem Akhtar Afghan of Supreme Court (SC) has remarked let all become exposed while case can disappear from system but not we and we are here.
He gave these remarks during hearing of appeal pleas filed by Imaan Mazari and Hadi Ali Chatha seeking suspension of their sentence.
The appeal pleas of Imaan Mazari and Hadi Ali Chatha seeking suspension of their conviction came up for hearing before a 2-member bench of SC presided over by Justice Naeem Akhtar Afghan.
During the hearing of the case Justice Naeem Akhtar Afghan inquired holidays in Islamabad High Court (IHC) are uptill when.
Additional Attorney General (AAG) told IHC will start working formally from September 6.
AAG took the plea appeal pleas regarding suspension of sentence are not maintainable.
Justice Ishtiaq Ibrahim inquired where is written in law about non maintainability.
Counsel Faisal Siddiqui told the court SC had ordered to give decision on the appeal pleas regarding suspension of sentence within two weeks. However SC order was not implemented.
AAG said IHC has its own system and cases are fixed according to it.
Justice Naeem Akhtar Afghan said it is better no opinion should be sought from us about IHC system
Faisal Siddiqui said case has been fixed in IHC suddenly for September 8. Whenever SC goes to decide , case is fixed in high court.
Justice Naeem Akhtar Afghan said “ Faisal Siddiqui Sahb let the system become exposed fully.
Faisal Siddiqui said cause list has not come so far. Lest the case should disappear from the system.
Justice Naeem Akhtar Afghan remarked case can disappear from system but not we.
Don’t worry. We are here.
Justice Ishtiaq Ibrahim remarked it has been said to give decision on the matter of suspension of sentence. The court can dismiss the petition.
The court adjourned the hearing of the case till September 17.
Justice Naeem Akhtar Afghan remarked on next hearing either we will be making decision or the petitioner will be withdrawing the case.
