SC rejects petition seeking court’s order for seizure of property of drug smuggler

Supreme Court (SC) has rejected the petition seeking court’s orders for seizure of property of smuggler after his conviction in drug smuggling case.
The petition was filed by Anti Narcotics against the decision of high court.
Chief Justice of Pakistan (CJP) Qazi Faez Isa remarked no officer from the departments appeared for assistance despite SC orders. The law officer who has appeared in this case is not having full information. Some one should have appeared from the side of department. There are no information even about the person against whom case has been instituted. Even they donot know about date of case. It is not known to them when FIR was lodged.
He gave these remarks while presiding over 3-member bench during hearing of Shumal Khan versus ANF case Thursday.
The law officer who appeared on behalf of ANF could not clarify the matter.
The court has got written in its order that the petitioner Haji Shumal Khan was convicted and his property was sealed.
When we inquired about the order issued regarding conviction then no facts were told in this regard. This order was issued by political agent in 1987 which he issues on behalf of commissioner Khyber,
It was written in the order 7 years imprisonment was awarded in this case which was commuted to 5 years.
It has been told with reference to property now ANF wants that his property be seized . The situation is this they have no full details. Neither any clarification was given nor were such circumstances presented that any thing could be said against high court decision. Therefore, the petition of ANF is dismissed.
