Entire bureaucracy, executive making joke of judiciary: IHC

Justice Mohsin Akhtar Kayani of Islamabad High Court (IHC) while expressing resentment over non implementation of court decision has remarked the entire bureaucracy and executive together are making joke of the judiciary.
The contempt of court case against finance secretary Imdad Ullah Bosal over non payment of pension to former Auditor General (AG) Pakistan Buland Akhtar Rana despite court’s orders came up for hearing in IHC.
The court expressed resentment over seeking time due to hearing of intra court appeal instead of implementing court’s order.
Justice Mohsin Akhtar Kayani remarked if intra court appeal is pending hearing then our order be got suspended otherwise court’s order be implemented.
Payment of monthly pension to the petitioner be ensured by the end of this month other wise there will be contempt of court with regret.
Justice Mohsin Akhtar Kayani further said if court’s order is not implemented then the account of Accountant General Pakistan Revenue and Auditor General will be freezed. The police officers who had subjected former Chief Justice of Pakistan Iftikhar Chaudhry were awarded punishment.
He further remarked the then IG, SSP, SP and Inspector were awarded punishment. Now these all officers have been retired but they all were convicted. They did not go to jail and they all are drawing pension now.
Justice Mohsin Akhtar Kayani said the entire bureaucracy and executive together are cutting joke with the judiciary. They accept the order when they will and they donot accept the order when they don’t will so.
It came into no one’s mind why he was not held responsible who had subjected former Chief justice of Pakistan to injustice.
Justice Mohsin Akhtsr Kayani remarked as to why the previous order of the court was not implemented. There is no thing like ego therein. The court has to get implement its decision. The trust of the court lowers in the eyes of people due to non implementation of its orders. Assistant Attorney General (AAG) told the court finance ministry has no objection over the pension of petitioner.
AGPR representative told we have filed intra court appeal . Court should give time. The court directed upon it that our order be got suspended in intra court appeal otherwise our order be implemented.
AGPR representative requested the court to give the date in the month of February. Intra court appeal will be decided till that time.
The court ordered monthly pension be paid to former auditor general Buland Akhtar Rana by the end of this month and court be told in January how much amount is left more and when it will be paid.
The court adjourned the hearing of this case till January 12 with these directives.
