SHC seeks mechanism to determine enforced disappearances

KARACHI: Sindh High Court (SHC) has sought mechanism for determination of enforced disappearances from federal and provincial governments during the hearing of the cases regarding recovery of missing persons.
Mother of missing citizens told the court Maaz and Talha are missing from area near airport since 2014.
The state counsel took the plea in the court 41 meetings of JIT and 17 meetings of PTF have been held for the recovery of citizens.
Justice Salah-ud-Din Panhwar remarked JIT had said no question arises of child and human trafficking in the country. While the matter of Saram Burni came to open on information from the foreigners.
The state counsel said the enforced disappearance of both the brothers has been determined.
The court inquired enforced disappearances mean what.
The counsel for Rangers explained gradation has been made for missing citizens. If there is eye witness then the case falls in the ambit of enforced disappearances. If there is no eye witness then the case comes in the category of missing persons automatically.
The court once again inquired is there any policy or mechanism regarding enforced disappearances. If there is no policy then it should be framed. How can we determine merely on the basis of allegations. In the report has it been written alleged before enforced disappearance or otherwise .
Counsel for Rangers told the court the word alleged has not been mentioned in the report.
The court remarked you have admitted . Policy should have been told to the institution which has worked out categories. If the case is of enforced disappearances then its responsibility will be fixed on whom. Federal and Sindh governments should tell policy would be framed when. If JIT is determining enforced disappearance then it means it is responsible. So many meetings of JIT have been held and the file has become fat so much but it is of what use .
The court directed committee be constituted comprising competent officers of law enforcement agencies. Committee should complete its work within two months and file its report.
The counsel for Rangers said the disappearances of children and girls too come in the ambit of missing persons cases.
The court while expressing annoyance stressed we are for this reason saying that categories be formed regarding missing persons so that it could become easy to understand them.
The court while issuing order to provide copies of court orders to federal government and interior ministry adjourned the hearing of the case for 2 weeks.
