SC stops IHC from further proceedings in audio leaks case

Supreme Court (SC) has stopped Islamabad High Court (IHC) from further proceedings in audio leaks case.
The court has suspended IHC May 29 and June 25 orders.
SC has issued notice to Bushra Bibi and Najam ul Saqib.
The court has said in its order on Monday Additional Attorney General (AAG) told the court’s proceedings of IHC has not been finalized. AAG told IHC transgressed the powers of hearing under article 199.
AAG said principle has been set in two decisions of SC high court cannot take suo motu notice.
The court was told that the five principles which were set in IHC hearing on May 31 , 2024 was not at all case of the petitioners. The court was told high court cannot investigate.
IHC May 29, 2024 order was reviewed. IHC May 29 order was not extended to next court proceedings. Extension has not been given to IHC May 29 order therefore, order is not being suspended.
The court remarked IHC cannot move ahead proceedings of audio leaks case.
IHC May 29 and June 25 orders are transgression of powers. IHC has no powers to take suo motu notice.
SC summoned record of audio leaks case on the request of federal government.
Justice Naeem Akhtar Afghan remarked unfortunately no one wants to reach the truth in this country. Inquiry commission was constituted to ascertain truth. SC gave it stay. Audio leaks case has not been fixed for hearing in SC again so far. Parliament was stopped when it tried to ascertain truth. if neither parliament will be allowed to work nor the court then truth will come to open how.
A two members bench of SC presided over by Justice Amin ud Din Khan took up the case for hearing Monday.
Justice Amin ud Din Khan inquired from AAG Aamir ul Rehman has high court determined who is recording audio.
He told the court it has not been determined so far. Investigation is underway. Authorities were stopped from phone tapping in May 29 order of IHC. Intelligence agencies are not conducting counter intelligence due to this order of IHC. They are not able to arrest any terrorist due to this order of high court. ISI and IB were stopped from phone tapping.
Justice Naeem Akhtar Afghan remarked upon it that no one wants to reach truth in this country. Inquiry commission was constituted to reach truth and it was given stay from the SC. Parliament was stopped when it tried to ascertain the truth. How the truth will come to open when neither courts nor the parliament will be allowed to work. Audio leaks case has not been fixed for hearing in SC again.
Justice Amin ul Din remarked this can be so too that audio was leaked by those with whom talks was being made. Has this aspect been seen. Now a days recording system is there in every mobile system. The court admitted federal government appeals against IHC decision for hearing and issued notice to the respondents.
