AC reserves judgment on the petitions seeking return of Toshakhana case against Zardari, Nawaz Sharif, Yousuf Raza Gilani to NAB

Accountability Court (AC) Islamabad has completed the hearing of Toshakhana reference against President Asif Ali Zardari and PML-N Quaid Nawaz Sharif and reserved judgment which will be announced on October 14.
Judge Abida Sajid of AC No 3 Islamabad heard the petition seeking returning the Toshakhana vehicles reference against Nawaz Sharif, Asif Ali Zardari, Yousuf Raza Gillani and others to NAB Wednesday.
Qazi Misbah Ul Hassan counsel for former Prime Minister (PM) Nawaz Sharif and pleader Rana Irfan appeared in the court.
Farooq H Naik , counsel for president Asif Zardari appeared in the court and told there are total 5 accused in this case.
Farooq H Naik read out NAB amendment law saying this case does not fall in the jurisdiction powers of this court due to NAB amendment law. This case is of worth 80.5 million which is less than 500 million. This case be returned to chairman NAB.
Judge Abida Sajjad said all the respondents are agreed on this point that this case does not fall in the jurisdiction power of this court. When this case had come then President Asif Ali Zardari was not enjoying immunity.
Farooq H Naik said when Asif Ali Zardari remained president earlier he got immunity. But when he left president ship he had appeared before NAB again. AC should return the reference to NAB. Next it lies in the powers of NAB to whom it sends the case. Now the case goes where , question will arise there can this case be made against President Asif Ali Zardari or not.
The counsels for Nawaz Sharif, Asif Ali Zardari and Yousuf Raza Gillani requested the court to send back the case to NAB.
NAB prosecutor said the allegation is there that the cheque bounced which was given by Asif Ali Zardari.
Farooq H Naik said when a case does not fall in the jurisdiction powers of AC then its merit will not be discussed. President Asif Ali Zardari enjoys immunity. Case cannot run against him. Case in respect of Asif Ali Zardari will be sent to FIA.
NAB prosecutor said Nawaz Sharif case will be separate. Case regarding Asif Ali Zardari will run separately.
NAB prosecutor said court has already given immunity to President Zardari. This case will stay here as long as Asif Ali Zardari is president.
Defence counsel said if this court retains this case then it is violation of law.
NAB prosecutor said court should return the case to the extent of Nawaz Sharif and keep the case with it to the extent of Asif Ali Zardari.
The court reserved judgment on the petitions seeking returning the Toshakhana vehicles reference against Nawaz Sharif, Asif Ali Zardari, Yousuf Raza Gillani and others to NAB.
