\nSupreme Court (SC) has remarked the civil servants are not bound to comply with the illegal orders even if these are given by the Prime Minister (PM). As per media report, these remarks were given by Justice Hashim Kakar during the hearing of the OGDCL appointments case in SC.
\nA 3-member bench of SC presided over by Justice Hashim Kakar took up illegal appointments in OGDCL case for hearing Tuesday. The court directed the lawyers to make preparations for the case.
\nDuring the hearing of the case the counsel for NAB told the court former minister Anwar Saifullah had asked chairman OGDCL to send appointment letters.
\nAccording to counsel for NAB the process of appointments should have been done through advertisement.
\nJustice Hashim Kakar remarked over staff appointments have been made in every government department.
\nJustice Salah ud Din Panhwar remarked people seek jobs from the ministers.
\nCounsel for NAB said overstaff appointments were made in OGDCL and principal staff officer of the minster had written there is pressure of parliament for appointments.
\nJustice Hashim Kakar said it is not binding on civil servants to comply with the illegal orders if these are given by PM.
\nNAB counsel replied if civil servants refuse to comply with the orders they can undergo the suffering.
\nCounsel for NAB told the court PIA was privatized due to over appointments.
\nJustice Ishtiaq Ibrahim said the appointments were made when Ehtesab Commission law was not in place.
\nJustice Ishtiaq Ibrahim said the respective federal minister has served punishment.
\nJustice Hashim Kakar said punishment is a blot and asked if it is not enough that minister has completed his punishment.
