BERLIN: Germany\u2019s top court ruled on Friday that the government could not simply \u200bcancel an entire swathe of resettlement places promised to Afghans, and that each case must be considered individually.<\/p>\n
The Constitutional Court backed a complaint by an Afghan mother and her two sons who had been selected in 2021 \u200cfor admission to \u200cGermany under a \u201chuman \u200brights \u200clist\u201d \u2060set \u200bup by \u2060the previous government after the Taliban returned to power.<\/p>\n
The decision by the current Interior Ministry to end the scheme in December 2025, voiding about 640 such promises without examining the individual cases, \u2060breached a constitutional ban on arbitrary \u200cstate action, it \u200csaid.<\/p>\n
\u201cEven where the executive \u200benjoys a broad \u200cmargin of discretion, it is never \u200ccompletely free,\u201d the court wrote.<\/p>\n
Once authorities have informed a person that he or she will be admitted, any subsequent reversal must \u200ctake that individual\u2019s circumstances into account, it added.<\/p>\n
The case must now \u2060be \u2060re-examined by the competent higher administrative court.<\/p>\n
The woman and her family are currently staying in Pakistan, where they have been receiving support funded by Germany.<\/p>\n
The court ruled that Berlin must continue supporting them in Pakistan until visas are issued or the ministry makes a new decision that is compliant \u200bwith the constitution.<\/p>\n
